Privacy policy:
Personal information you supply to us is used to provide you with the services you have opted for. It is not used for any other purpose or supplied to any other third party without your prior permission.
Statistical information about the website will be based numerically on number of clients, advertisements or CVs and will not include any personal information given. This website uses up to date security devices to prevent unauthorised access.
USE OF THIS SITE.
Job advertisements, CVs and personal profiles should not contain any further advertising or web links unless prior approval has been gained from Careers in Collections. Information uploaded to this site must not discriminate based on race, sex, religion, age, disability or sexual orientation, nor should it be defamatory, obscene or intended to incite hatred. Careers in Collections reserves the right to suspend or cancel its services without refund should such material appear on this site. The information and services provided by this site are meant for use by individuals seeking jobs and by employers or other agencies seeking to recruit staff. It is not intended as an introduction or supplier site. Careers in Collections Ltd does not guarantee that the information supplied by individuals and/or companies is correct, including identity, suitability, qualifications, experience, authorisation to work in a specific country, ability to do the job or references. Individuals and companies are responsible for ensuring that they adhere to the laws governing employment and for the accuracy of the content they upload to the site. For further information it is recommended that users of this site read the Employment Agencies and Employment Business Regulations 2003 to ensure suitability for a role.
CANDIDATES
As a job seeker it is your responsibility to check the identity and nature of any recruiter, start date and duration of any role advertised, details about the role (type, location, hours, health and safety, necessary prior training/experience and qualifications, payment details, expenses) as well as checking if there are any legal requirements which you need to meet before accepting a role.
CLIENTS
As a recruiter it is your responsibility to ensure a candidate's identity, qualifications, prior experience and training, suitability and any necessary background checks as well as checking if there are any legal requirements which need to be met before the commencement of a placement.
Where specific qualifications are required or if the role is sensitive or involves working with vulnerable people or children you should ensure you obtain documented evidence of the required qualifications and/or authorisations. In addition you should obtain a minimum of two references from unrelated sources and perform a background check through the criminal records bureau.
The search facilities present on this site are intended as an aid to narrow your search and not as a substitute for thorough checks.
TERMS AND CONDITIONS OF BUSINESS FOR RECRUITERS.
In this document:
• "Client" refers to any company or agency advertising on this site
• "Candidate" refers to job seekers or any individual uploading their profile and/or Curriculum Vitae.
• "Services" refers to any recruitment information, tools, products or services offered on this site.
• "Contract month" refers to one full calendar month beginning on the first day of the month and finishing on the last day of that month.
• "Partial month" refers to a contract commencing mid month.
• "Contract term" refers to the agreed length of the given contract.
Services will not be provided until Careers in Collections Ltd. is in receipt of a signed contract (where appropriate) and cleared payment for the relevant services.
PRICING
For clients choosing to take up a 12 month contract prices are guaranteed for the duration of the contract. Single jobs and job package prices are subject to change.
Advertisements are posted for 28 days unless otherwise agreed. Extensions to this duration will be charged for as separate postings, except for clients with a 12 month contract who have unlimited postings. Job advertisements greater than the number purchased in a given package will be charged on an individual job rate of £199 per job. If a client deletes or edits an existing job advert this will be treated as a new posting and will be charged accordingly.
Job packages are valid for 6 months from date of purchase. Any unused job advert credits cannot be carried over or refunded.
All prices quoted are exclusive of VAT. Invoices are payable within 28 days of issue date. After this time Careers in Collections Ltd. reserves the right to suspend services until payment is received. Late payments will be subject to an interest charge at 3% above Lloyds TSB's base rate. We reserve the right to charge interest under the Late Payment of Commercial Debts (Interest) Act 1998.
LIABILITY
Our total liability in contract, tort (including negligence or breach of statutory duty), misrepresentation or otherwise, arising in connection with the performance or contemplated performance of the services under this Contract shall be limited to the amount you have paid to us in respect of the relevant advertisement(s).
TERMINATION
The 12 month contract can be terminated, however the remaining monthly payments will still be due until the end of the 12 month period.
Termination without charges is possible only in the following situations:
• Careers in Collections Ltd. are in breach of these terms and condition for more than 10 working days after being notified of such breach in writing and recommendation to rectify the breach.
• Careers in Collections Ltd. ceases to trade, goes into liquidation or becomes insolvent. Careers in Collections Ltd. may cancel the contract if any of the following occur:
• The client is in breach of these terms and condition for more than 10 working days after being notified of such breach and recommendation to rectify the breach.
• The client ceases to trade, goes into liquidation or becomes insolvent. In respect of 12 month contracts any outstanding payments will still be due.
ADVERTISING
Job advertisements will go live from receipt of cleared funds. Advertisements paid for by credit card will go live upon approval. Advertisements paid for by BACS payments will take approximately 2 days to go live. Advertisements paid for by cheque will go live once the cheque has cleared. This may vary. You will be notified by email when your jobs have gone live.
Job advertisements placed on the site must be for genuine jobs, containing no other information or advertising. Careers in Collections Ltd reserves the right to remove any advert deemed to be in any way discriminatory, without refund.
Recruiters are expected to maintain professional courtesy and fairness at all times on their responses to applicants. In agreeing to abide by these terms and conditions you confirm that you will do nothing to bring Careers in Collections into disrepute and will indemnify us against any claim brought by an individual arising from this or any other breach or these terms and conditions.
USE OF THE DATABASE
Careers in Collections Ltd retains the database rights and all other copyright and property rights. You acknowledge that you do not acquire any rights in the database or its content and that your use of the database and its content is governed by the following rules:
The data you receive from the database will depend upon the product purchased from us. Once you have access to this data you may
i. View, save or download it to your own database using the Candidate Search facility and its associated functions only for the purpose of finding suitable candidates for specific job vacancies that you or your client wish to fill.
ii. Contact the individuals using the information given, in relation to specific job opportunities.
iii. Treat the information as confidential for use only in connection with the specific recruitment needs.
You will not:
i. Pass on any information from the candidate database to anyone outside your company except with the express permission of the candidate.
ii. Download the database through any automated process.
iii. Make inappropriate use of any of the information given by candidates or use it for any other purpose outside of finding suitable candidates for specific vacancies.
Deletion of database material
You agree to delete all material from the candidate database upon its replacement with up-to-date material or the satisfactory conclusion of your search for a suitable candidate, whichever occurs first. You must adhere to the Data Protection Act 1998.
USERNAMES AND PASSWORDS:
Usernames and passwords are for the use of the person they were issued to. Do not give your username or password to anyone else. If Careers in Collections Ltd has reason to suspect that usernames and passwords have been circulated or are otherwise being used by an unauthorized person we reserve the right to revoke them.
Transfer of rights and obligations
This contract between you and Careers in Collections Ltd. is binding on you, Careers in Collections Ltd and on any respective successors and assigns.
You may not transfer, assign, charge or otherwise dispose of the Contract, or any of your rights or obligations arising under it, without our prior written consent.
Careers in Collections Ltd may transfer, assign, charge, sub-contract or otherwise dispose of the Contract, or any of our rights or obligations arising under it, at any time during the term of the Contract.
Events outside our control
Careers in Collections Ltd will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control (Force Majeure Event).
A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:
• strikes, lock-outs or other industrial action;
• civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war;
• fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster;
• impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport;
• impossibility of the use of public or private telecommunications networks; or
• the acts, decrees, legislation, regulations or restrictions of any government.
Our performance under any Contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. Careers in Collections Ltd will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under the Contract may be performed despite the Force Majeure Event.
Waiver
If Careers in Collections Ltd fails, at any time during the term of a Contract, to insist upon strict performance of any of your obligations under the Contract or any of these terms and conditions, or if we fail to exercise any of the rights or remedies to which we are entitled under the Contract, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations. A waiver by us of any default shall not constitute a waiver of any subsequent default.
No waiver by us of any of the terms and conditions of this Contract shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing.
Severability
If any of the provisions of this Contract are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.
Entire agreement
These terms and conditions and any document expressly referred to in them represent the entire agreement between us in relation to the subject matter of any Contract and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing. We each acknowledge that, in entering into a Contract, neither of us has relied on any representation, undertaking or promise given by the other or be implied from anything said or written in negotiations between us prior to such Contract except as expressly stated in these terms and conditions.
Neither of us shall have any remedy in respect of any untrue statement made by the other, whether orally or in writing, prior to the date of any Contract (unless such untrue statement was made fraudulently) and the other party's only remedy shall be for breach of contract as provided in these terms and conditions.
Viruses, Hacking and other Offences
You must not misuse this site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack.
By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. Careers in Collections Ltd will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately without refund of payment.
Careers in Collections Ltd will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any material posted on it, or on any website linked to it.
Careers in Collections Ltd right to vary these terms and conditions
We may revise these terms and conditions at any time. You are expected to check this page from time to time to take notice of any changes we have made, as they are binding on you. Some of the provisions contained in these terms and conditions may also be superseded by provisions or notices published elsewhere on our site.
Reliance on Information Posted
Commentary and other materials posted on our site are not intended to amount to advice on which reliance should be placed. We therefore disclaim all liability and responsibility arising from any reliance placed on such materials by any visitor to our site, or by anyone who may be informed of any of its contents.
Law and jurisdiction
This Contract will be governed by English law. Any dispute arising from, or related to, such Contracts shall be subject to the exclusive jurisdiction of the courts of England and Wales.
